Your acknowledgment of our privacy policy

This Privacy Policy is published in order to meet our requirements under the Privacy Act 1988 (Cth) including the APPs, Spam Act 2003 (Cth) and The Do Not Call Register Act 2006 (Cth).

This policy does not confer or create any rights upon individuals or impose on AUSVEG Ltd. any obligations or rights outside of or in addition to those imposed by the above legislation.


Collection of your personal information

Personal information is information or an opinion that identifies an individual or from which your identity can be reasonably ascertained (and regardless of the form of the information, and regardless of whether it is true or not). Examples of personal information we collect include: names, addresses, email addresses, phone, records of communication with us and facsimile numbers. This personal information is obtained in many ways including via our website www.ausveg.com.au and from third parties. We don’t guarantee website links or policy of authorised third parties. We collect your personal information for the primary purpose of providing our services to you. We may also use your personal information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing lists at any time by contacting us in writing or using the link at the bottom of any e-mail. When we collect personal information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.


What types of personal information do we collect

We only collect personal information if it is necessary for one of our functions or activities. The types of personal information we collect will depend on the reason for collection.

We collect personal information, including names and contact details, about: visitors, contractors and suppliers who come onto any of our sites in case of emergency; people involved in or through organisations that we support or sponsor; and people who correspond with us, including through our website, in which case we may keep a copy of that correspondence and relevant contact details.

When you visit the site to read, browse or download information, our system may record/log your IP address (the address which identifies your computer on the internet and which is automatically recognised by our web server), date and time of your visit to our site, the pages viewed, and any information downloaded. This information will only be used for the purpose of site analysis and to help us offer you improved online service. We may automatically collect non-personal information about you such as the type of internet browsers you use or the site from which you linked to our websites. You cannot be identified from this information, and it is only used to assist us in providing an effective service on our Web Sites.


How do we collect, store, hold and protect personal information?

Where it is reasonable and practicable to do so, we collect your personal information directly from you when you correspond or register your details with us, enter into arrangements with us, or provide feedback to us. Depending on the nature of our interaction with you, we may collect personal information from third parties – for instance, information about job applicants.

We hold personal information electronically and, in some cases, hard copy form, both at our own secure premises and with the assistance of our service providers. We take all reasonable steps to ensure that the personal information that we hold is protected from loss, misuse, unauthorised access by ensuring that this information is held on secure servers in controlled facilities and that information stored within our computer systems can only be accessed by those entrusted with authority and computer network password sanctions.

We require our contracted providers to do the same. Our staff are bound by strict requirements regarding the protection of the privacy of the information we collect and hold about you.

Our contractors are required to comply with the Australian Privacy laws.

We may occasionally need to provide third parties with contact details in the carrying out of company business. AUSVEG Ltd. takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.


Information collected on this website

We may collect non-personal information from you such as browser type, operating system and web pages visited to help us manage our website. We use cookies and other internet technologies to manage our website; however, these technologies will only collect personal information where you have opted in to such a feature.


Why we collect, hold and use personal information

AUSVEG Ltd collects personal information from you for a specific reason as described in APP 3. This is referred to as the primary purpose. AUSVEG Ltd will not use or disclose the collected information for a secondary purpose unless you consent to Ausveg doing so, or under the circumstances involved, AUSVEG Ltd believe you would reasonably expect AUSVEG Ltd to use or disclose the information for a secondary purpose related to the primary purpose.

We may use personal information for the primary purpose for which it is collected (eg. provision of our services, including administration of our services), or for purposes related to the primary purpose where it would reasonably be expected that we would use the information in such a way, or in other limited circumstances set out in the Privacy Act.

For each visitor reaching the site, we collect the following non-personally identifiable information described above. From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future, data collected from the time of the policy change will adhere to our updated practices.


We collect, hold and use personal information to:

  • any purpose for which the information was requested and any directly related purpose;
  • enable third party service providers to provide us and our related companies and membership with services such as information technology, auditing, legal advice, printing and mailing services, and services relating to our membership and organisation purposes;
  • correspond with people who have contacted us, and deal with feedback;
  • provide services to, and manage, our related companies;
  • correspond with people regarding our corporate sponsorships;
  • developing, improving and marketing products and services;

  • maintain and update our records.

We do not disclose personal information to third parties unless we are permitted to do so by law or we have obtained consent to do so. We may disclose personal information for the primary purpose for which it is collected or for purposes related to the primary purpose where it would reasonably be expected that we would use the information in such a way. Also, we are permitted to disclose personal information in circumstances set out in the Privacy Act (including but not limited to disclosures to our related companies).

AUSVEG Ltd may also disclose your personal information or sensitive information if it is required to do so by an Australian law, by order of a court or tribunal or if AUSVEG Ltd reasonably believes that the use or disclosure of the information is reasonably necessary for an enforcement related activity, by or on behalf of an enforcement body, in which case AUSVEG Ltd will make a written note of the use or disclosure. A disclosure may also be made where a permitted general situation or permitted health situation exists as provided for in the APPs.


Third Parties we may disclose your personal information to include:

  • Our related companies and members;
  • Our service providers and professional advisors including IT service providers, auditors, legal advisors, mail houses and member organisations;
  • Financial institutions;
  • The organisations we support or sponsor; and
  • Government agencies.

We take steps to ensure that our service providers are obliged to protect the privacy and security of personal information and use it only for the purpose for which it is disclosed.

The third parties to whom we disclose personal information will generally be located in Australia. We may use cloud computing solutions or data storage located overseas in which case information may be stored, under our control, on computer servers located outside of Australia.

Your personal information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your personal information.

AUSVEG Ltd. reserves the right to make amendments to this Privacy Policy at any time. If you have objections to the Privacy Policy, you should not access or use the AUSVEG Ltd website.


Period of time we keep your personal information

We generally keep your personal information active for as long as is reasonably required to enable us to meet your needs.

We keep membership records and other personal information on file to enable us to undertake statistical and historical analysis and reporting. As part of our data security, we regularly backup and archive our electronic databases.


Accessing and correcting Your Personal Information, and complaints and questions

Under Australian privacy law, you have rights of access to personal information we hold about you. These rights also include correction of any errors in this information. Should you wish to access this information please contact us (refer bottom of page).

You can request access to your personal information held by us, or request that it be corrected, by contacting us at the address below. To ensure confidentiality, details of your personal information will be passed on to you only if we are satisfied that the information relates to you. A fee will not be charged for an access request, but you may be charged the reasonable expenses we incur (such as search and copying costs). If we refuse to provide you with access or correct the personal information held about you by us (in accordance with the Privacy Act), then we will provide reasons for such refusal.

If you wish to make a formal complaint, please make your complaint in writing to our Privacy Officer. We will consider your complaint promptly and contact you to seek to resolve the matter. If we have not responded to you within a reasonable time or if your concerns are not resolved to your satisfaction, you are entitled under the Privacy Act to make a complaint to the Office of the Australian Information Commissioner.


Direct Marketing

AUSVEG Ltd will only use personal information collected for the purpose of direct marketing where AUSVEG:
  • collected the information;
  • believes you would reasonably expect AUSVEG to use or disclose the information for direct marketing; and
  • provide an option for you to request that AUSVEG do not use the information for direct marketing – and you have not taken up this option.

If AUSVEG Ltd collected the information involved from you and you would not reasonably expect AUSVEG Ltd to use or disclose the information for the purpose of direct marketing, or collect the information from someone other than you, AUSVEG Ltd will only use or disclose the information with your consent or where it is impracticable to obtain your consent. Either way, a simple means will be provided to you by which you may request not to receive direct marketing communications from AUSVEG Ltd.

When AUSVEG Ltd uses or discloses any personal information collected for direct marketing purposes, those materials will provide you with an option to declare you do not wish to receive such material in the future. If requested, AUSVEG Ltd will provide you with the source of any information used or disclosed for direct marketing purposes, whether that direct marketing be by AUSVEG Ltd or another organisation. AUSVEG Ltd will also provide you with the opportunity to request that it, or the other organisation, does not send direct marketing information to you. AUSVEG Ltd will not charge for that request and will action it in a reasonable time frame. You may also request that AUSVEG Ltd not use or disclose information to facilitate direct marketing by other organisations.


Third Parties

Where reasonable and practicable to do so, we will collect your personal information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Our site may contain links to other sites. We are not responsible for the privacy practices or policies of those sites and recommend that you review their privacy policies.


Cross-border disclosure of information

The service providers used to support the AUSVEG Ltd business (including to handle personal information on AUSVEG Ltd behalf where required or for complimentary software to support business functions) may be based in Australia or in countries overseas. Where possible, AUSVEG Ltd will take reasonable steps in the circumstances to ensure overseas recipients comply with the Act, or any corresponding law in the relevant jurisdiction, when handling information and have precautionary measures in place to protect your information from misuse, interference, loss and unauthorised access, modification or disclosure.

AUSVEG Ltd will only transfer personal information about an individual to someone (other than a member of AUSVEG or the individual) who is in a foreign country if AUSVEG Ltd reasonably believe that the recipient of the information is subject to a law or binding scheme substantially similar to the way in which the APPs protect the information and there are mechanisms that can be used to take action or enforce those laws or binding scheme. AUSVEG Ltd may also transfer personal information cross-border if you specifically consent to AUSVEG doing so, or AUSVEG are required to do so under Australian law or an order of a court or tribunal, a permitted general situation exists, or AUSVEG are required or authorised by or under an international agreement relating to information sharing to do so. Otherwise, AUSVEG will take reasonable steps under the circumstances to ensure that the overseas recipient does not breach the APPs in relation to the information.
